Project Overview
MHP is an international food and agri-tech company with production facilities across Ukraine and Europe. The company produces poultry under the “NASHA RYABA” brand, one of the most recognizable food brands in Ukraine.
To strengthen the legal protection of its flagship brand, MHP initiated proceedings to have the “NASHA RYABA” trademark recognized as a well-known trademark in Ukraine in respect of poultry products in Class 29 of the Nice Classification.
The status of a well-known trademark provides a significantly broader scope of protection than a standard trademark registration. It extends protection beyond the registered goods and services and serves as a powerful legal tool against unauthorized use and unfair exploitation of the brand by third parties. At the same time, obtaining well-known status is one of the most demanding trademark procedures, requiring compelling evidence of widespread consumer recognition, substantial market presence, and a strong business reputation.

In addition, we prepared detailed legal arguments demonstrating that the trademark satisfied the statutory criteria for recognition as a well-known trademark under Ukrainian legislation and internationally recognized IP protection standards. Our attorneys represented the client’s interests before the Appeals Chamber throughout the entire proceedings.
Result
The Appeals Chamber recognized “NASHA RYABA” as a well-known trademark in Ukraine with effect from 1 January 2019.
The recognition date is of particular legal significance, as it establishes the effective date of enhanced protection and serves as the reference point when assessing the legality of third-party use of identical or confusingly similar signs.
As a result, the client obtained an expanded scope of trademark protection and stronger legal mechanisms to prevent unfair competition and unauthorized use of its brand in the Ukrainian market.
