Representation of the interests of the Client (one of the largest SEO-companies on the market of Ukraine) before the Patent Office of Ukraine regarding registration of a trademark. The Patent Office took a decision on provisional refusal of registration of our Client’s mark «
» on the ground of similarity with a combination mark «
» that was earlier registered in Ukraine (international registration № 1410875 as of 11.04.2018) in the name of SAMSUNG ELECTRONICS CO., LTD.
The associates of our Agency prepared a reasoned and grounded response to the refusal of the Patent Office based on the following:
— substantial distinctiveness of marks on graphical ground (distinctiveness in writing and scripts; moreover, the cited mark contains an original figurative element that dominate over the verbal part of a mark);
— the distinctiveness of the goods and services that constitute the activities of the Client (area of Search Engine Optimization, contextual advertising and Internet-marketing) and the owner of the cited mark (application for mobile phones and tablets);
— the mark of the Client is known to the Ukrainian consumers with regard to the indicated activities that confirms the substantive and serious preparation for its use.
As a result, the Patent Office has taken a favorable decision on registration of the Client’s mark.
